Self defense is what we can an affirmative defense against a charge. So my client’s being charged with let’s say domestic violence, and our defense is an affirmative defense of self defense. You actually have to satisfy certain elements in order to fulfil the self defense requirement. And that is that you were being attacked, and that you used the least possible defense in order to prevent any further harm to yourself, without overwhelming the attacker. So it’s a very delicate balance in that situation as well. I’ve had the good fortune of being in trial where we used the affirmative defense successfully, because the evidence and the facts were on our side. Self defense is an important aspect in a domestic violence case, and we have a lot of experience at it at Dallo law.
