What is Considered Kidnapping in Michigan?

Restraining a person and committing another crime while doing so is often referred to as kidnapping. The crime is defined under Section 750.349 of the Michigan Penal Code as any person who knowingly restrains another person with the intent to do one of the following:

  • Hold that person for reward or ransom;
  • Use that person as a hostage or shield;
  • Engage in criminal sexual contact or penetration with that person;
  • Take the person out of the state;
  • Hold and keep the person in involuntary servitude;
  • Engage the child in sexually abusive activity as the term is defined under section 145c of the Michigan Penal Code;

The term “restrain” in this context is to restrict a person’s movements or to confine them, so it interferes with that person’s liberty without their consent or the legal authority. For a person to be restrained, there doesn’t have to be a particular length of time required and may be related or incidental to the commission of other criminal acts.

Kidnapping is a felony punishable by imprisonment for life or any terms of years or a fine of not more than $50,000.00.

Unlawful Imprisonment Charges in Michigan

Another crime commonly associated with kidnapping is unlawful imprisonment. The crime is defined under section 750.349b of the Michigan Penal Code and states a person is guilty of the offense if they knowingly restrain another under the following circumstances:

  • Restrained by means of weapons or other dangerous instruments.
  • The person restrained was also secretly confined.
  • The person was restrained so the offender could facilitate the commission of another felony or to facilitate flight after commission of another felony.

The term “secretly confined” refers to any one of the following:

  • Keeping the confinement of the restrained person a secret.
  • Keeping the location of the confined person a secret.

Unlawful imprisonment is a felony punishable by up to 15 years in prison and a possible fine of up t $20,000.
