In drug possession cases you typically have the possession, you have possession with the intent to distribute or deliver, and you have unlawful delivery of said controlled substance whatever it may be. Possession is typically defined by the individual use or consumption by that one person. Possession with the intent to deliver usually turns on or hinges on how much is possessed. The authorities will try to make the case that this person this suspect, had so much that this couldn’t have been for individual use. This person possessed it and intended to sell it. And then you have the third one that I mentioned which is the unlawful delivery. This is where the person is being charged with actually completing a delivery. Those are the three main ones that I see in my office when it comes to the possession, distribution of drugs. And what we try to do is examine the elements of a case. And see whether the charge fits the facts of the case. And we go from there in defending our client. And making sure that our client’s rights weren’t violated, and challenging the prosecution’s case from the beginning.
