What are RICO Charges?
As stated previously, The Racketeer Influenced and Corrupt Organization Act (RICO) was passed by Congress with the purpose of seeking to eliminate organized crime in the United States. Organized crime consists of an enterprise in which members engage in criminal activity, often for illegal profit. While some organized crime enterprises focus only on financial gain, others may aim to retain personal benefits.
Specifically, under 18 U.S. Code § 1962, It is unlawful for anyone employed by or associated with any enterprise to participate, directly or indirectly, in the conduct of such enterprise’s affairs through a pattern of racketeering activity or collection of unlawful debt. The RICO statute is specific and applies to any “pattern of racketeering activity,” which is defined as having within the preceding 10 years committed two or more of the following offenses:
- Bribery
- Embezzlement
- Extortion
- Gambling
- Money laundering
- Obstruction of justice
- Mail fraud
- Wire fraud
- Counterfeiting
- Trafficking counterfeit goods
- Drug trafficking
- Human trafficking

Penalties Under the RICO Act
