Michigan Health Care Fraud Laws

Health care fraud can be committed in several ways including providing false information to receive benefits, impersonating another person to receive their benefits, or tampering with a paper or digital system to receive some sort of benefit. According to section 400.613 which constitutes the Medicaid False Claim Act, Michigan law prohibits an individual from:

  • Receiving a benefit that he or she is not entitled to by reason of fraud, making a fraudulent statement, or knowingly concealing a material fact.

The offender who violates this statute will be required to forfeit and pay to Michigan the full amount received. For each claim, he or she must pay a civil penalty of $5,000 to $10,000 plus triple the damages the state suffered.

Michigan Health Care False Claims Act

Michigan also provides the Health Care False Claims Act, which can be found in section 752.1003 of the Michigan Legislature. The act prohibits:

  • Fraud in the obtaining of benefits or payments in connection with health care coverage and insurance
  • Kickbacks or bribes in connection with such coverage and insurance
  • Conspiracies in obtaining benefits or payments

A person who violates §752.1003 is guilty of a felony, which is punishable by up to 4 years in prison and/or up to $50,000 in fines.

Federal Penalties for Health Care Fraud

The United States also imposes severe penalties for healthcare fraud at the federal level. Federal prosecutors can pursue criminal health fraud charges under a variety of federal statutes such as 18 U.S.C. Section 1347. This specific statute makes it a federal crime to defraud a health care benefit program or to fraudulently obtain any funds held by federal health care programs (Medicare, Medicaid).

The penalty for this type of health care fraud is up to 10 years of incarceration. However, if the fraud causes a person serious bodily injury the maximum penalty is 20 years imprisonment. If the fraud causes a person’s death, the maximum penalty is up to life in prison.
